Terms and Conditions

By booking or travelling with My Waka Your Waka Limited (‘the Operator”), you (“the passenger”) agree to the terms and conditions set out below; acknowledging that passenger transport services may involve inherent risks beyond the Operator’s reasonable control:
1. The Passenger will comply with all instructions and safety requirements provided by the Operator relating to health, safety, and passenger conduct.
2. In the event of illness or injury requiring urgent assistance during travel, the Passenger authorises the Operator to arrange reasonable medical treatment or emergency assistance on the Passenger’s behalf. Any associated costs are the Passenger’s responsibility.
3. The Operator may photograph or record journeys, vehicles, or activities for operational, safety, promotional, or marketing purposes. Where required by law, Passenger consent will be obtained before identifiable images are used for promotional and marketing purposes.
4. The Passenger is responsible for their personal belongings. The Operator accepts no responsibility for loss of, theft of, or damage to personal property, except where liability cannot be excluded by law.
5. While the Operator will take all reasonable steps to provide safe and reliable transport services, it accepts no liability for delays, cancellations, diversions, missed connections, or additional expenses arising from circumstances beyond its reasonable control.
6. To the fullest extent permitted by Aotearoa/New Zealand law, the Operator’s liability for any loss, damage, injury, or expense arising from the provision of transport services is excluded or limited, except where such liability cannot legally be excluded.
7. Passengers undertaking the Tongariro Alpine Crossing or any other walking, hiking, or outdoor excursion are responsible for ensuring they are physically fit, suitably equipped, and adequately prepared for the activity and prevailing conditions. 
8. Passengers must assess their own ability to safely participate in activities described at clause 7, and follow all safety information, warnings, and guidance provided by relevant authorities and operators.
9. The Tongariro Alpine Crossing and similar activities involve inherent risks, including but not limited to changing weather conditions, uneven terrain, slips, falls, dehydration, fatigue, injury, illness, and other hazards beyond the Operator’s control. Participation in such activities is entirely at the Passenger’s own risk. 
10. If the Passenger is unsure of their ability to undertake activities described at clause 7; the Operator highly recommends that they procure an experienced guide to escort them.
11. The Operator recommends that Passengers obtain appropriate travel insurance to cover unforeseen events, cancellations, delays, medical expenses, and personal property loss or damage.
Our services are provided in good faith and all care is taken to ensure the safety of our passengers.
Booking Terms

Refundable: Once your booking is confirmed, a 25% cancellation fee applies. To receive a refund (minus this fee), please contact us at least 7 days before your booking date. For bookings made within 7 days of the service date, you must notify us at least 48 hours before your booking to be eligible for a refund.

Changing your booking: If you need to move your booking to another day, please get in touch. We’ll do our best to help, but changes are not guaranteed and depend on availability.  

We appreciate your understanding – these policies help us manage our schedule, allocate vehicles and drivers, and keep our service running smoothly for everyone.

Other Conditions

Prices are subject to change. Any increases since the date of issue are at the cost of the customer payable to the Operator.

All material on this website cannot be used for any purpose without permission. This website may only be accessed via a standard web browser.

Changes to Terms and Conditions

The Operator reserves the right to change these Terms and Conditions at any time without notifying users.

Payment

All prices on this website are quoted in New Zealand dollars.  A booking is considered confirmed when full payment is received and the Operator is not obligated to begin or complete any service without full payment in advance.  Payment for bookings is required in full at the time of booking. Payment can be made via bank transfer in New Zealand dollars, ANZ FastPay Tap or cash.  For payments made using a credit card issued from a country other than from a New Zealand bank, depending upon the currency in which your card was issued, your credit card provider may impose foreign exchange fees and other fees in accordance with your arrangements with that credit card provider. The Operator is not responsible for currency conversion or any fees imposed by your credit card provider.

Booking Confirmation 
Upon completion of your booking, a receipt of payment and booking confirmation will be emailed.

Governing Law This website and all component parts, including the Terms and Conditions are covered exclusively by the laws of New Zealand.
